MATTRESS LIMITED LIFETIME WARRANTY
For all Bear Mattress® Mattresses purchased starting 02/01/2025, your new Bear Mattress® Mattress is covered by a limited lifetime warranty. This limited lifetime warranty gives you specific legal rights and covers all manufacturing defects. You may also have other rights, which vary from state to state. If you think you need to claim your warranty, please let us know! Please see below for additional details.

Products Covered by This Limited Lifetime Warranty.
This limited lifetime warranty (“Limited Lifetime Warranty”) extends to mattresses manufactured by Brooklyn Bedding, LLC d/b/a Bear Mattress® ("Bear") and purchased directly from Bear Mattress® or Bear Mattress®'s authorized retailers. This Limited Lifetime Warranty includes the Bear Elite Hybrid Mattress, Bear Natural Mattress, Bear Star Hybrid Mattress, Bear Pro Hybrid Mattress, Bear Original Mattress, Bear Cub - Kids Mattress, and the Bear Trundle Mattress, which collectively will be referred to as “Mattresses” (plural) or “Mattress” (singular) unless otherwise noted. Some parts of this Limited Lifetime Warranty also extend to covers sold with Mattresses ("Mattress Covers"). Mattresses are designed to work on a firm, solid-surface, on a bed base that is structurally capable of supporting the weight of the Mattress and user(s).
Who This Limited Lifetime Warranty Extends To.
This Limited Lifetime Warranty extends to the original purchaser of any Mattress who is located in the United States (not including US territories) or Canada. This Limited Lifetime Warranty is valid only for the period of time the Mattress is owned by the original purchaser of the Mattress. The "Original Purchaser" or “you”, for the purposes of this Limited Lifetime Warranty, is the first purchaser of the Mattress from Bear Mattress® or a Bear Mattress® authorized retailer. PLEASE RETAIN A COPY OF YOUR RECEIPT AS PROOF OF PURCHASE. All Bear Mattress® warranties are not transferable.
Bear Mattress®'s Limited Lifetime Warranty and Responsibilities.
Bear Mattress® warrants the Mattress in its original packaging against the defects in material and workmanship set forth below ("Defects") for the full period of the Original Purchaser’s ownership and use, from the time the Mattress is purchased by the Original Purchaser (the “Original Purchase Date”), and when the Mattress is used normally for its intended purposes.
YEARS 1-10: NON-PRORATED COVERAGE
For the first 10 years from the Original Purchase Date, the Mattress is warranted against non-excluded defects in the workmanship or materials. During this time, Bear Mattress® will repair or replace any defective Mattress at no cost to the Original Purchaser.
YEARS 11-END OF OWNERSHIP: PRORATED COVERAGE
From year 11 through the remainder of the period of the Original Purchaser’s ownership and use, Bear Mattress® will replace the Mattress at a prorated charge to the Original Purchaser. The prorated replacement charge will depend on the year the Mattress is replaced.
During years 11-15 of the Limited Lifetime Warranty, the prorated replacement charge the Original Purchaser will pay will be fifty (50) percent of the then current retail price of the same model and size as the original Mattress purchased.
During years 16-20 of the Limited Lifetime Warranty, the prorated replacement charge the Original Purchaser will pay will be sixty (60) percent of the then current retail price of the same model and size as the original Mattress purchased.
From year 21 through the remainder of the period of the Original Purchaser’s ownership and use of the Mattress, the prorated replacement charge the Original Purchaser will pay will be seventy-five (75) percent of the then current retail price of the same model and size as the original Mattress purchased.
Any replacement will be of the same model and size as the original Mattress purchased. In no event will a substitution model be used as a replacement except in the case of a discontinued Mattress. In this event, a Mattress of like build and design, at Bear Mattress®’s discretion, will be used as a replacement for the defective Mattress. Replaced or repaired Mattresses are subject to the same Mattress Limited Lifetime Warranty as the original Mattress. If the Original Purchaser obtains a replaced or repaired Mattress, the Limited Lifetime Warranty term of the replaced or repaired Mattress begins from the Original Purchase Date.
Removing the Mattress Cover from a Mattress will automatically void any Limited Lifetime Warranty claim. Please contact Bear Mattress® in advance or if you have any questions.
What This Limited Lifetime Warranty Covers.
This Limited Lifetime Warranty applies to the following Defects in a Mattress:
- Deterioration causing the Mattress to have a visible indentation greater than one and one-half (1.5) inches that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation or adjustable bed base. Normal wear requires that a Mattress be continuously supported by a matching foundation or adjustable bed base with a proper bed frame sufficient to support the collective weight of the Mattress and foundation. Any foundation, box spring, frame, or other base on which the Mattress is placed that has slats greater than 5.5 inches apart will be considered improper and will void the Limited Lifetime Warranty.
- Any physical flaw in the Mattress that causes the foam or spring material to split or crack, despite normal usage and proper handling.
- Any manufacturing defect in the assembly of the Mattress Cover.
This Limited Lifetime Warranty does not cover the following:
- A normal increase in softness of the foam pressure-relieving material which does not affect the pressure-relieving qualities of the Mattress.
- Comfort preference beyond the 120 night trial period.
- Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains; provided, that the Defect is caused by such abuse or damage.
- For years 1 – 10 of this Limited Lifetime Warranty, replacement of any non-defective pieces in the Bear Mattress® sleep system (for example, if you purchase a mattress with multiple components and only one component is defective, then we will only replace the defective component).
- Any mattress (whether manufactured by Bear Mattress® or not) sold by resellers who are not authorized retailers of Bear Mattress®.
- Mattresses sold "as-is", "preconditioned", "reconditioned", "used", "comfort return", "returned", "previously owned", or any other similar wording indicating that the Mattress is not "new" or of "first quality", or has previously been purchased or used by another consumer.
In the event of a Defect, Bear Mattress®'s sole and exclusive liability and the Original Purchaser’s sole remedy under this Limited Lifetime Warranty will be, at Bear Mattress®'s option, to provide a repaired or replacement Mattress or Mattress Cover of similar or greater value, as applicable, and subject to the Original Purchaser’s fulfillment of "Purchaser Responsibilities" below.
Purchaser Responsibilities.
In the event of a Defect and in order to get the benefit of this Limited Lifetime Warranty, the Original Purchaser must return the Mattress or Mattress Cover to Bear Mattress® and provide Bear Mattress® with proof of the original date of purchase. Mattresses and Mattress Covers must be sent to the address set forth at the end of this Limited Lifetime Warranty.
If Bear Mattress® deems a claim made under this Limited Lifetime Warranty is valid, Bear Mattress® will repair or replace (as applicable) and ship the Mattress or replacement Mattress back to the Original Purchaser. Please note Bear Mattress® takes all efforts to complete these requests as quickly as possible and some cases can take longer than others.
Disclaimer, Limitation on Liability.
TO THE EXTENT PERMISSIBLE BY APPLICABLE LAW, THE MATTRESS IS PROVIDED "AS IS" AND THIS LIMITED LIFETIME WARRANTY IS YOUR EXCLUSIVE WARRANTY AND REPLACES ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
TO THE EXTENT PERMISSIBLE BY APPLICABLE LAW, ALL IMPLIED WARRANTIES ARE HEREBY DISCLAIMED. SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE AND JURISDICTION TO JURISDICTION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND EXCEPT AS SET FORTH IN THIS LIMITED LIFETIME WARRANTY, IN NO EVENT WILL BEAR MATTRESS® OR ITS SUPPLIERS BE LIABLE FOR OR PROCUREMENT OF SUBSTITUTE PRODUCTS OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATED TO THE MATTRESS OR ITS USE BY YOU OR ANY THIRD PARTY, WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), INDEMNITY, PRODUCT LIABILITY OR OTHERWISE. THIS LIMITATION WILL APPLY EVEN IF BEAR MATTRESS® HAS BEEN ADVISED OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. BEAR MATTRESS®'S TOTAL LIABILITY WILL NOT EXCEED THE PURCHASE PRICE PAID FOR THE MATTRESS GIVING RISE TO SUCH LIABILITY.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
Arbitration.
In the event a dispute arises between you and Bear Mattress® arising out of this Limited Lifetime Warranty, such dispute will be determined and settled by binding arbitration between the parties, in accordance with the Commercial Arbitration Rules of the American Arbitration Association ("AAA"). More information about the AAA is located at www.adr.org, or you can call the AAA at 1-800-778-7879.
You must seek arbitration for disputes arising out of this Limited Lifetime Warranty prior to exercising any rights or seeking any remedies created by the Title I of the Magnuson Moss Warranty Act. If you choose to pursue any rights and remedies that are not created by Title I of the Magnuson Moss Warranty Act, then arbitration is not required.
Arbitration will take place in New York, New York.
The arbitration will not be combined with any other proceeding or arbitration against one of the parties. Each party will designate one arbitrator and the two designated arbitrators will select a third arbitrator, who will serve as the chair of the arbitration panel. If the two arbitrators cannot agree on the third arbitrator, then the AAA will appoint the third arbitrator. Barring extraordinary circumstances, the arbitrators will issue their decision within 120 days from the date the third arbitrator is selected by the two designated arbitrators or appointed by the AAA. The arbitrators may extend this time limit for an additional 30 days in the interests of justice. All arbitration proceedings will be closed to the public and confidential and all related records will be permanently sealed, except as necessary to obtain court confirmation of the arbitration award. The decision and the arbitrators' award will be in writing and will include a statement setting forth the reasons for the disposition of any claim. A dissenting decision will also be set forth in writing. The arbitrators' award will be final and binding on the parties, and judgment thereon may be entered in any court of competent jurisdiction.
Governing Law.
This Limited Lifetime Warranty will be governed by the laws of the State of New York, without giving effect to its conflict of laws rules.

BEAR MATTRESS PROTECTOR 10 YEAR WARRANTY
Brooklyn Bedding LLC warrants the Bear Mattress Protector (the “Product”) to the original end-user (“Purchaser”) from manufacturing defects for a period of 10 years from Date of Purchase. The warranty covers the protector product only. The Purchaser is responsible for all shipping costs to Brooklyn Bedding LLC. DO NOT SHIP THE PRODUCT TO Brooklyn Bedding LLC WITHOUT FIRST OBTAINING AN AUTHORIZATION NUMBER AND INSTRUCTIONS. DO NOT RETURN THE PRODUCT TO THE RETAILER WHERE YOU PURCHASED IT.
This warranty covers manufacturing defects only. Damage to the product caused by improper use or by abuse, misuse or not properly following the care instructions will void the warranty. Brooklyn Bedding LLC is not responsible for any incidental or consequential damages resulting from the use of its products. In no event shall the responsibility of Brooklyn Bedding LLC exceed the purchase price of the warranted product. This warranty will only be honored when accompanied by a copy of the original proof of purchase from an authorized retailer, reseller or distributor.
Brooklyn Bedding LLC reserves the right, upon the presentation of a product covered by the warranty, to repair or replace same, at its sole option. In the event that a particular product is no longer manufactured, Brooklyn Bedding LLC shall have the right to replace same with a substitute product that most nearly resembles the warranted item.
This warranty is the sole warranty given by Brooklyn Bedding LLC, and shall extend only to the Purchaser. The warranty covers the Bear Weighted Blanket only. The Purchaser is responsible for all shipping costs to Brooklyn Bedding LLC. Bear Adjustable Base Warranty
PRODUCT WARRANTY
“Buyer’s Customer” means the consumer who originally purchased the applicable Product at retail directly from Buyer or one of Buyer’s authorized resellers.
“Warranty Start Date” means, with respect to any Product, the date of purchase of such Product under this Agreement.
“First Year” means, with respect to the sale of any Product, the first year after the Warranty Start Date for such Product.
Seller makes the following warranties with regard to the Products (collectively, the “Product Warranty”):
(i) During Years 1 through 2: Seller warrants that, during the two year period after the Warranty Start Date, the Products (including all Structural Parts (as defined below)) will be free from defects in materials and workmanship; and
(ii) During Years 3 through 10 for Structural Parts: Seller warrants that, during the third through tenth years after the Warranty Start Date, all steel and aluminum structural parts contained in the Products (the “Structural Parts”) will be free from manufacturing defects.
In order to be eligible for service under the Product Warranty, Buyer (or where applicable Buyer’s Customer) must comply with the terms of this Addendum B. The Product Warranty for a Product begins on the Warranty Start Date, and the Product Warranty lasts for the two different periods described above. The Product Warranty for a Product terminates immediately upon any sale or transfer of such Product by Buyer’s Customer.
Coverage during Year 1: If a Product has defects in materials or workmanship during the First Year, Seller will supply a new or refurbished replacement Product or Product part free of charge to (as instructed in writing by Buyer) Buyer or Buyer’s Customer, upon the terms of this Addendum B. Seller will pay all shipping costs to deliver such replacement parts to a location within the United States.
Coverage during Years 2: If a Product has defects in materials or workmanship during the second year after the Warranty Start Date, Seller will supply a new or refurbished replacement Product or Product part free of charge to (as instructed in writing by Buyer) Buyer or Buyer’s Customer, upon the terms of this Addendum B, except that Buyer will pay all shipping costs to deliver such replacement Product or part for all warranty claims made after the First Year.
Coverage during Years 3 through 10 for Structural Parts: Structural Parts do not include any electrical or electronic parts or components such as drive motors and massage motors. If any Structural Part has a manufacturing defect during the third through tenth years after the Warranty Start Date, Seller will supply a new or refurbished replacement Structural Part free of charge to (as instructed in writing by Buyer) Buyer or Buyer’s Customer, upon the terms of this Addendum B. Buyer will pay all shipping costs to deliver such replacement Structural Parts for all warranty claims made during the third through tenth years after the Warranty Start Date.
The Product Warranty does not cover:
- Any Product used at any time for commercial or medical purposes or any purpose other than residential consumer use.
- Any Product which is not purchased new.
- Any Product which is purchased through any reseller who is not authorized by Buyer to resell the Product.
- Any modifications to the Products or any damage caused by the modifications.
- Batteries, mattresses, fabric, sheets, pillows, or any items supplied by Buyer or by third parties (including without limitation Buyer’s Customer).
- Labor, service, handling, or other costs or fees to remove any defective Product or Product part or install any replacement Product or Product part.

Any damage to the Product caused by any of the following:
- Buyer or third parties,
- accidents, fire, flood, “acts of God,” or other actions or events beyond the reasonable control of Seller,
- any unauthorized service or repairs or the improper installation of replacement parts,
- improper handling (including without limitation during shipping) or physical or electrical abuse or misuse,
- ordinary wear and tear, or
- any failure to operate the Product in compliance with the operation and maintenance procedures, instructions, and guidelines contained in the Product Owner’s Manual (which is available online at www.[web site address].com/warranty), including without limitation any failure to follow: (a) the recommended weight restrictions or (b) the guidelines for proper distribution of weight on the Product.
- Any other costs or expenses not covered by the Product Warranty.
Product Warranty claims must be made within thirty (30) days after Buyer, or Buyer’s Customer, becomes aware of a defect and within the applicable Product Warranty periods described above. Product Warranty claims after such times are not valid claims. Buyer or Buyer’s Customer must provide to Seller: (a) an original proof of purchase in the form of the original sales receipt (in digital or physical form), packing slip, purchase confirmation, or credit card statement, (b) the name of the person or entity from whom Buyer’s Customer purchased the Product, and (c) the serial number of the Product.
Buyer will guide Buyer’s Customers through the Product Warranty service process. Seller will provide Buyer with written troubleshooting steps to evaluate whether a Product Warranty claim is covered. Buyer’s Customer must undertake these troubleshooting steps in order to determine whether the Product Warranty claim is covered. If Seller delivers replacement parts to Buyer or Buyer’s Customer, Seller will provide instructions for the removal of the defective part and installation of the replacement part. Buyer or Buyer’s Customer will be responsible for removing any defective Product or Product part and installing any replacement Product or Product part, including without limitation any labor, service, and handling fees and costs. Neither Buyer nor Buyer’s Customer may send a defective Product or defective part to Seller without a return material authorization number issued by Seller. Upon Seller's request, Buyer must return, or must ensure that Buyer’s Customer returns, any defective Product or defective parts to Seller within thirty (30) days after Buyer or Buyer’s Customer receives the replacement Product or part, provided that Seller will be responsible for the shipping costs to return such defective Product or part. If Buyer or Buyer’s Customer do not return the defective Product or all defective parts to Seller within the thirty (30) day period, Buyer will pay to Seller the costs of the replacement Product or parts, including without limitation any shipping costs incurred by Seller in shipping such replacement Product or parts.
Seller shall have a reasonable opportunity to inspect the Products at issue. For any Product which Seller determines does not conform to the Product Warranty, Seller’s sole liability and obligation, and Buyer’s sole and exclusive remedy, shall be, at Seller’s sole discretion, either to repair or replace any such Product pursuant to the terms of this Addendum B. If the Product or any replacement part is not available for any reason, Seller may provide a replacement product or part of comparable quality and price. A Product Warranty period is not extended if Seller repairs or replaces the Product or any part of the Product. The Product Warranty is limited to Buyer and Buyer’s Customers located in the 50 U.S. States.

Bear Mattress Closeout and Clearance Items
Unless otherwise indicated, products purchased from Bear that are marked as “Closeout” or “Clearance” are subject to the modified limited warranty terms described below:
Your new Bear Mattress that was purchased that was marked as a “Closeout” or “Clearance” item is covered by the Mattress Warranty described above, provided that the term of such warranty extends for a period of 5 years from the date you purchased the Bear Mattress. All other terms and conditions of the Mattress Warranty will apply as specified above.
